“Buyer”, “Customer” or ” You “means anyone who buys or agrees to buy products from the seller.
“He” refers to he or she or any gender.
“Seller” means www.exportbeds.com the online order and sales platform of BEST INTERNATIONAL BUYERS CO., LTD (Registered in Guangdong, Foshan, China, company No 914406055516723054) located in Guangdong Foshan Chancheng Shiwan Heping Road, 1506 Creative City Zone C E-Commerce Building, 12th Floor Bespoke or personalized” these are goods that are made to order especially for the buyer in configuration, type or finish not already predefined on the website or clearly stipulated as custom.
Anytime you give us your email ,send an email to exportbeds.com or a text message through What’app, you are communicating with us in an electric format. This gives us the permission to to communicate back to you in the same electric format, either by e-mail or text written on our website.
With this, we both mutually agree that any contracts, agreements, disclosures or notices, or any other communication that is provided to you by exportbeds.com satisfies all legal notification requirements. You acknowledge that exportbeds.com may send you e-mails for promotional purposes. By accepting these terms and conditions you consent to receiving such e-mails. You may opt out from receiving promotional e-mails at any time.
All content included on this site, such as text, graphics, photos, logos, button icons, images, audio clips, digital downloads, data compilations, are protected by International copyright laws. 6.Placing an Order
The following conditions apply to any order the buyer place through our website. By placing an order at exportbeds.com, the buyer is accepting the conditions set forth.
Once an order is placed the buyer is under obligation to pay for the goods based on the payment method selected. Please ensure to check the order carefully for the correct orientation if a corner sofa , module options if a modular sofa and of course correct finish.
An order confirmation will be sent to you once an order is confirmed and you may also login to your account 24/7 to access your order and comments with regards to the progress of your order.
Please inform us if you are not able to login.
With regards product finishes, please request physical samples if you are at all unsure as the exact finish colour.
Colours may vary on different devices and screens so the best true to life colour would be in person in your own environment.
Please read the conditions carefully prior to purchasing an order to make sure you are accurate as we cannot be held responsible for your incorrect selections, sizing or finishes once an order is placed.
Save as otherwise provided otherwise here the Price shall be as stipulated on the seller’s website at the date of order of products. All products are due payment at the time the buyer places an order including delivery charges.
Once you have placed your order with us we will send you an order confirmation with the products itemized including any additional services pertaining to the order. If you do not receive an order confirmation please contact us immediately as email and instant message to the seller’s online what’s app account and or by mail,this process is used to keep you appraised of the progress of your order.
7.Custom-Order and Customized Furniture
Custom-order and customized furniture are made on special request and as per customer’s specific selections hence all custom-order and customized furniture is non-refundable and non-exchangeable.
Customers are responsible to check the “Custom Request Instructions’ as stated in the order invoice before order confirmation as production is based solely on the Custom Instruction provided by customers.
Please be advised that exportbeds.com do not encourage Customer to use and/or supply their own Fabric and/or Material for upholstering or related purpose simply because Factory worker may not be familiar with the supplied and/or given material and the outcome result may not be as desired. However if customer choose to proceed to supply their own material, exportbeds.com will not and cannot be held liable if the outcome is unsatisfactory.
Customer is encouraged to view and select the size color and material . They may be slight colour variation from computer screens and mobile phone colour setting. Customer take full responsibility for their selection . Colour swatches are for reference only. It is normal that slight colour variation may occur hence export.beds.com will not and cannot be held liable in this situation.
Production lead time varies depending on the production complexity of individual products, the estimated production lead time will be indicated in order invoice however export.bed.com will not be liable for any unexpected delays including but not limited to events taken place in the production factory and/or during transportation which may have been the cause.
Orders will be confirmed upon receiving customer’s detail information customade request and payment.
A 30 % downpayment is required for order confirmation.Upon payment reception our custom-made specialist will commence producing .The production’s progress will be sent to customer for information.
All custom-made furniture is made specially as according to customer specification request .
Please note that all reference photo(s) provided by customer serves as reference only.exportbeds.com do not and cannot guarantee that the custom-made furniture ordered can be replicated and/or made to exact detail however the production sample or drawings will be provided to customer for review and confirmation approval before production.
The term “Overall Finish” , “External/Surface Finish”, “Internal Finish” is a general term used to imply the selected finish customer have selected however it does not imply that it will be completely finish. If not otherwise specifically requested by customer, areas including but not limited to top, back, underside and/or unexposed area will be ‘raw’ finish.
Please note that it is normal for new furniture to have a smell to it. For customers who suffers from allergies, please make it clear to our custom-made specialist and this information will be included into the order invoice under ‘Special Request’ or ‘Note’. Fuurn will not be held liable if information is not listed and/or included in the order invoice.
All payments have to be settled before delivery. exportbeds.com reserves the right to immediately remove or schedule for a removal of purchase if customers has refuse payment.
All custom-made furniture is made base on the customer’s confirmation of production sample, drawing(s)/ sketches which including, but not limited to details such as width, depth and height of each section, thickness of each supporting boards, for customer’s review and approval confirmation before commence large scale of production hence all custom-made furniture is non-exchangeable and non-refundable.
9.Cancellation & Returns
Bespoke/custom made furniture or personalized items are not cancelable.
If the Buyer is dissatisfied with a purchase for any reason he may, within fourteen days of delivery, contact the Seller by sending a letter or e-mail to arrange for the collection of the products. Notifications must be within this period and in writing or no return will be possible.
Buyers should retain all the original packaging upon receipt of any delivery bought at a distance this may be required in the unlikely event of a return.
Returns to the point of delivery are entirely at the buyer’s cost and responsibility. The returned goods should be available to the seller for inspection to establish the nature, characteristics, and functioning of the products. Further, the goods must be packaged back up in the same way as received using the existing materials or to the same standard as received and the goods must be as new. Any damaged packaging should be made good to ensure a safe return of the products. Please indicate any missing or defects at the time you notify us of a return in writing.
Orders for Furniture upholstery (covers) are custom made as per the customer’s request and as such, non-cancellable and non-refundable.
10.Problems, Faults Damages
We aim to get customers’ product/s in perfect condition every time and we also take extra steps to ensure goods are very well packaged for their journey so as to prevent any problems with the goods on arrival.
Sometimes issues may still arise with some items on some occasions. Most issues are remediable and we suggest you accept goods so we can deal with any issues ASAP. If you are unsure please call us on 0086 13726386230 at the point of delivery so we can assist with the best course of action.
If in the unlikely event of delivery of incorrect or damaged goods, or in the event that you discover any defect in the goods for which you require assistance, please report the issue/s as soon as possible. This should be sent in writing by emailing firstname.lastname@example.org. We ask that the buyer do this as soon as possible so as the longer the buyer take to report any issues will lead the seller to draw alternative conclusions as to how any issues may have arisen.
Please note: Indicating problems on the delivery note will not be accepted as notification to the Seller. exportbeds.com must be contacted directly.
In so far as is permitted by law, the Sellers only liability to the Buyer under these terms and conditions will be, at the Sellers sole discretion, to make good any shortage or non-delivery, to replace or repair any goods which are received by the Buyer in a damaged or defective state or to refund to the Buyer any sums actually paid by the Buyer for the goods in question. The Seller will not be liable to the Buyer for any indirect or consequential loss or damage arising out of any problem the Buyer notifies to the Seller and will have no liability to the Buyer for any failure or delay in delivering goods or any damage or defect in goods delivered which is caused by any event or circumstance which is beyond the Sellers reasonable control.
Delivery Service as generally stated is a one-time service only unless otherwise stated in the order or invoice.
If the delivery address is not stated in the invoice, the ‘Address’ as provided by client will be used as the delivery address.
Delivery Service is carried out only during exportbeds.com office hours. Night Delivery Request are subject to additional surcharge.
If customer would like their orders to be delivered into a specific location, exportbeds.com can on behalf of customer organize for delivery service however this service has to be paid in advance.
Our team will coordonate the delivery and will contact the customer directly to schedule a date and time.
If the customer would like to reschedule a delivery, there will be a rescheduling fee of 300RMB. To do so, please contact us immediately for rescheduling, if required.
12.Self-Pickup Service /External Delivery Service/International Shipment
All service provided by export-beds.com will be carried out during working hours only.exportbeds.com makes no guarantees or warranties against grazing, scratching and/or wear on the stone and solid wood veneer surface or otherwise, and all products are sold subject to natural variation in color, flow, grain, tonality, spotting, veining, shade and texture.
Upon self-pickup, the customer is encouraged to inspect the purchased items as all items transported/installed by the customers’ means and/or second party is non-refundable and non-exchangeable.
External Delivery Service
exportbeds.com on behalf of customer can assist with organizing for external delivery and international shipping service via a third party ,however it is the customer’s responsibility to receive purchased goods at the designated delivery point.
exportbeds.com cannot and does not guarantee the condition of the purchased items during transportation through external delivery services as all items transported by the customer and /or third party (including external delivery) are non-refundable and non-exchangeable.
The Delivery of goods sold under FOB Terms with full container load service is made by the seller to the port of departure mentioned and selected by the buyer on www.exportbeds.com.
The Delivery of goods sold under EX-Work Terms are delivered to a delivery point stipulated by the buyer at the time the orders placed , exclusively within Lecong Furniture Hub Shunde Foshan or at the seller’s premises in Foshan.
The Seller shall use his reasonable endeavors to meet any date agreed for delivery.
Due to the complex nature of supplying made to order goods, the Seller cannot be responsible for delays to orders which are beyond its control, Force Majeure. This includes unforeseen factory delays, adverse weather conditions, shipping company delays and acts of God. The seller will make every effort to deliver within stipulated delivery times on the product at the time of order. Should the Force Majeure Event continue for a period of more than 2 months, then either party will have the right to terminate any contract that exists between seller and buyer , forthwith without any further liability to the other party apart from providing the buyer with a refund if the goods have not been delivered as agreed.
As our storage facilities are limited and for transit purposes only, we reserve the right to charge a storage charge in the event you do not reasonably accept delivery. If the Buyer is unable to take delivery or collect your order within 15 days after it becomes available or within the order period, a daily storage charge of 19 $per cubic meter will apply until acceptance delivery of the buyer’s order.
Images (including photos and videos) of products on www.exportbeds.com are for illustrative purposes only.
They may not represent the accurate colours of the products as different monitors and devices render colours differently.
The buyer accepts that for leather or fabric finishes, the seller cannot be responsible for colour and finish shade and texture variation. The seller has the right to change the product finish to be a reasonably similar in appearance and colour to the original product. This includes any replacements and provided at a later stage as these are provided on the basis of being a like for like replacement however may not be 100% matching the original product finish due to “environmental conditions” or batch variation.
The buyer accepts that for bespoke or personalised items which are made to order especially for the customer, these may take up to 2-4 weeks longer for delivery.
Photographs shown on the Sellers Web site and catalogue are for illustrative purposes only, and may not exactly match the product itself. While every effort is made to ensure the accuracy of colour reproduction, colour may vary according to the settings of the Buyers monitor, software or printer.
All measurements shown on the Sellers Web site and catalogue and are approximate.
We cannot accept liability for any minor alterations made by the supplier which represent to material change.
14.Price and Payment
Unless otherwise provided, all payments shall be made in USD or equivalent value in RMB .
If Payment haven’t been made in time as stipulated during the order, the seller reserve the right to adjust the due payment amount in case of depreciation of the USD towards the Hong Kong Dollar, based on the order’s day rate by Bank of China.
The buyer may request of the seller to perform services other than those mentioned and payable on www.exportbeds.com,the seller will act in place of the buyer, on the behalf of buyer ,and in the buyer’s interest. Actions resulting to the proxy may not be imputable to the buyer’s responsibility and in any way be considered as liability interfering with buyers obligations to this contract.
Risk or damage to or loss of the Products shall pass to the Buyer upon delivery.
Notwithstanding any other provision here in title in the full Products shall not pass to the Buyer until the Seller has received in cash or clear funds payment in full.
The Seller shall not be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside its reasonable control, including but not limited to strikes, lock outs, accidents, war, fire, reduction in or unavailability of power at the Sellers premises, manufacturing plant or its agents premises, breakdown of plant or machinery or shortage or unavailability of raw materials from a natural source of supply, and the Seller shall be entitled to a reasonable extension of its obligations. This Contract shall be governed by the law of The People’s Republic of China , question or remedy howsoever arising shall be determined exclusively by the Courts of Foshan
18. Dispute Resolution
We want to resolve any complaints or issues as soon as possible and with least fuss and stress to both parties. We therefore advise all customers to follow our own internal complaints procedures for any issues and by sending us an email to email@example.com.
Please send any supporting pictures along with your case. Most cases can be resolved this way.
